These Terms and Conditions ("Terms") govern all purchases made through www.furnicher.com ("Website") operated by Furnicher, a trading name of Republic Group BV, a company incorporated under the laws of the Netherlands.

2. Scope and Applicability
These Terms apply to all offers, orders, and agreements between Furnicher and customers ("you") who purchase Products through the Website. By placing an order, you confirm that you have read, understood, and agreed to these Terms.

Furnicher reserves the right to amend these Terms at any time. The version applicable to your order is the version in effect at the time you placed it. We will clearly indicate the date of the most recent revision.

 

3. Products and Pricing
3.1 Product Information
We strive to present our Products as accurately as possible, including descriptions, images, dimensions, and colours. Due to the nature of furniture manufacturing, minor variations in colour, texture, or dimensions may occur. These variations do not constitute defects and are not grounds for a claim.

3.2 Pricing
All prices displayed on the Website are in Euros and include VAT where applicable. Shipping costs are displayed separately before you confirm your order. Furnicher reserves the right to adjust prices at any time, but price changes will not affect orders that have already been confirmed.

3.3 Pricing Errors
In the event of an obvious pricing error, Furnicher reserves the right to cancel the order and notify you. If the correct price is lower than stated, we will charge the lower amount and proceed with delivery. If the correct price is higher, we will contact you before proceeding and you may choose to cancel.

 

4. Ordering and Contract Formation
An order placed through the Website constitutes an offer to purchase. The contract between you and Furnicher is formed when we send you an order confirmation by email. Furnicher reserves the right to refuse or cancel any order at its discretion, including but not limited to cases of pricing errors, stock unavailability, or suspected fraud.

We may request additional verification before accepting an order. If your order is cancelled after payment has been processed, we will issue a full refund to your original payment method.

 

5. Payment
We accept the payment methods displayed on the Website at checkout. Payment must be completed before your order is dispatched. All transactions are processed in Euros.

 

6. Delivery
Furnicher delivers to the Netherlands, Germany, France, and Belgium. Estimated delivery times are provided during the order process and in your order confirmation. These are estimates only and not guaranteed delivery dates.

Risk of loss or damage passes to you upon delivery to the address you provided. If delivery fails due to your absence or an incorrect address provided by you, additional delivery costs may apply.

Shipping carriers vary depending on your delivery country and the nature of the product. Specific carrier information will be included in your shipping confirmation.

 

7. Right of Withdrawal (Cooling-Off Period)
In accordance with EU Directive 2011/83/EU and applicable national legislation, you have the right to withdraw from your purchase within 14 calendar days from the day you or a person designated by you (other than the carrier) receives the Product, without giving any reason.

7.1 How to Exercise Your Right
To exercise your right of withdrawal, you must inform us by means of a clear statement (e.g., email to contact@furnicher.com) of your decision to withdraw. You may use the model withdrawal form provided below, but this is not obligatory.

To meet the withdrawal deadline, it is sufficient that you send your communication before the 14-day period has expired.

7.2 Effects of Withdrawal
If you withdraw from the contract, we will reimburse all payments received from you, including standard delivery costs (but not supplementary costs if you chose a delivery option other than the least expensive standard delivery offered by us). We will make the reimbursement within 14 days from the day on which we receive the returned Product or you provide evidence of having sent it back, whichever is earlier.

We will use the same means of payment you used for the initial transaction, unless you expressly agree otherwise. In any event, you will not incur any fees as a result of the reimbursement.

7.3 Return Conditions
You must return the Product without undue delay and in any event no later than 14 days from the day on which you communicate your withdrawal. The Product must be returned in its original packaging, in the same condition as received. You are permitted to inspect the Product as you would in a physical store, but you are liable for any diminished value resulting from handling beyond what is necessary to establish the nature, characteristics, and functioning of the Product.

You bear the direct cost of returning the Products to our warehouse in the Netherlands unless otherwise agreed.

8. Warranty and Conformity
All Products are covered by the statutory warranty of conformity under EU law. This means the Product must correspond to the description given by the seller, be fit for the purposes for which goods of the same type are normally used, and show the quality and performance which are normal in goods of the same type.

If a Product is not in conformity with the contract, you are entitled to have the Product brought into conformity free of charge by repair or replacement, to receive an appropriate reduction in the price, or to have the contract rescinded, in accordance with applicable consumer protection legislation.

 

9. User Accounts
When you create an account on our Website, you are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You must notify us immediately at contact@furnicher.com of any unauthorised use or security breach.

Furnicher reserves the right to suspend or terminate accounts that violate these Terms.

 

10. Intellectual Property
All content on the Website, including but not limited to text, images, logos, designs, software, and trademarks, is the property of Furnicher or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content on the Website without our prior written consent.

 

11. Fraud Prevention
To protect our customers and business, Furnicher monitors transactions for fraudulent activity. We reserve the right to cancel any order, refuse service, or block user accounts if we reasonably suspect fraud, including but not limited to:

•       Use of stolen or unauthorised payment methods

•       Providing false or misleading personal information

•       Systematic abuse of promotional codes or discount schemes

•       Repeated refusal to accept delivered orders

•       Any other conduct that Furnicher reasonably considers fraudulent or harmful to the business

If an order is cancelled due to suspected fraud, we will notify you. If payment was already processed, a refund will be issued to your original payment method after verification.

 

12. Promotions and Discount Codes
Furnicher may offer promotions, discount codes, or special offers from time to time. Unless stated otherwise, only one discount code may be applied per order. Discount codes cannot be combined, exchanged for cash, or applied retroactively. Furnicher reserves the right to modify or withdraw any promotion at any time.

 

13. Privacy
Your personal data is processed in accordance with our Privacy Policy and the General Data Protection Regulation (GDPR). Please refer to our Privacy Policy, available on the Website, for full details on how we collect, use, store, and protect your personal data.

 

14. Limitation of Liability
To the fullest extent permitted by applicable law, Furnicher shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Website or Products, including but not limited to loss of data, revenue, or profit.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by law. Your statutory consumer rights remain unaffected.

The Website may contain links to third-party websites. Furnicher is not responsible for the content, accuracy, or practices of any third-party sites. Inclusion of a link does not imply endorsement.

 

16. Online Dispute Resolution
The European Commission provides an Online Dispute Resolution (ODR) platform, which you can access at: https://ec.europa.eu/consumers/odr. Our email address is contact@furnicher.com. We are not obliged and generally not willing to participate in dispute resolution proceedings before a consumer arbitration board.

 

17. Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of the Netherlands. Any disputes arising from or in connection with these Terms shall be submitted to the competent court in Amsterdam, the Netherlands.

If you are a consumer residing in the EU, you also benefit from mandatory consumer protection provisions of the law of your country of residence. Nothing in these Terms affects your rights as a consumer under applicable EU legislation.

 

18. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. The invalid provision shall be replaced by a valid provision that most closely reflects the intent of the original.
